Terms of Service

These Terms of Service (“Terms”) govern your use of TripReclaim, a service provided by Pivot Point Media Holdings LLC (“Company,” “we,” or “us”). By using TripReclaim, you agree to these Terms.

1. Description of Service

TripReclaim is a flight price monitoring service that tracks airline ticket prices after purchase and notifies users when prices drop. We provide information, claim instructions, and email templates to assist users in requesting refunds or travel credits from airlines. We do not guarantee that airlines will honor any refund or credit request.

2. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract to use TripReclaim. By using the service, you represent that you meet these requirements.

3. Subscription Plans and Payments

TripReclaim offers the following plans:

• Per Trip: $2.99 one-time fee per booking monitored
• Monthly: $4.99/month for unlimited monitoring
• Annual: $39/year for unlimited monitoring (approximately $3.25/month)

Payments are processed securely by Stripe. Subscription plans automatically renew until cancelled. You may cancel at any time through the billing portal in your dashboard. Refunds are not provided for partial subscription periods.

4. SMS Text Message Alerts — TCPA Consent

TripReclaim offers optional SMS text message alerts as part of its service. By enabling SMS notifications in your account settings, you agree to the following terms governing our SMS program.

Program Description: TripReclaim Price Drop Alerts — flight price drop notifications, 24-hour full refund window alerts, and account-related transactional messages sent from (888) 516-5777.

Message Frequency: Message frequency varies based on your monitored bookings and price activity. You may receive multiple messages per booking during active monitoring periods, particularly during the first 24 hours after booking submission.

Message & Data Rates: Message and data rates may apply. All charges are billed by and payable to your mobile service provider. TripReclaim does not charge separately for SMS messages — they are included in your subscription.

Supported Carriers: AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, Cricket, Metro PCS, U.S. Cellular, and most major US carriers. Coverage is not guaranteed for all MVNOs or in all geographic areas. TripReclaim is not liable for delayed or undelivered messages.

Consent Records: We maintain records of your SMS opt-in consent including the date, time, and method of consent as required by TCPA compliance standards. These records are retained for a minimum of 4 years.

Revocation of Consent: You may revoke SMS consent at any time by replying STOP, disabling the SMS toggle in your account settings, or contacting us at hello@tripreclaim.com. Revocation is effective within 10 business days of receipt.

5. User Responsibilities

By using TripReclaim, you agree to:

• Provide accurate booking information including correct flight details and prices
• Provide a valid mobile phone number that you own and are authorized to use for SMS receipt
• Notify us immediately if your mobile number changes so we can update your account
• Use TripReclaim only for your own personal travel bookings
• Not use TripReclaim for commercial resale or bulk booking operations
• Comply with all applicable airline policies and terms when requesting refunds
• Not attempt to circumvent, hack, or reverse-engineer our systems

6. No Guarantee of Refunds

TripReclaim provides price monitoring and claim assistance only. We do not guarantee that airlines will approve any price adjustment, refund, or travel credit request. Airline refund policies are subject to change and vary by fare type, airline, and booking circumstances. You assume all risk in deciding whether to submit a refund claim.

7. Airline Relationships

TripReclaim is not affiliated with, endorsed by, or partnered with any airline. Airline logos and trademarks are property of their respective owners and are used for identification purposes only. Submitting a price drop claim is your responsibility and must comply with the relevant airline’s terms and conditions.

8. Intellectual Property

All content, features, and functionality of TripReclaim — including but not limited to text, graphics, logos, software, and claim templates — are owned by Pivot Point Media Holdings LLC and are protected by applicable intellectual property laws.

9. Limitation of Liability

To the maximum extent permitted by law, TripReclaim and Pivot Point Media Holdings LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including lost profits, failed refund claims, or data loss. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for any failure to deliver SMS messages due to carrier issues, network outages, or incorrect phone numbers.

10. Disclaimer of Warranties

TripReclaim is provided “as is” and “as available” without warranty of any kind. We do not warrant that the service will be uninterrupted, error-free, or that price data will be accurate or complete. SMS message delivery is not guaranteed and may be affected by your carrier, network conditions, or geographic location.

11. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may cancel your account at any time through your dashboard settings or by contacting us at hello@tripreclaim.com. Upon account termination, SMS notifications will be automatically disabled.

12. Privacy

Your use of TripReclaim is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy contains additional details about our SMS program, data collection, and TCPA compliance practices.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms, including those related to our SMS program and TCPA compliance, shall be resolved in the courts of the State of Delaware.

15. Legal Disclaimer

TripReclaim operates as a price monitoring and notification service only. We do not process refunds, contact airlines on your behalf, or guarantee any financial outcome. Our full Legal Disclaimer governs the scope of our service, the limits of our responsibility, and your obligations as a subscriber.

Key points from our Legal Disclaimer:

• No guarantee of refund — Whether a price drop results in a refund depends entirely on airline policies, fare class, timing, and other factors outside our control.
• Airlines control the refund process — All refunds and travel credits are issued solely by the airline. TripReclaim does not contact airlines on your behalf.
• Data accuracy — Fare prices and policy information are retrieved from publicly available sources and may not be current at the time you act on an alert.
• Geographic scope — TripReclaim is designed primarily for U.S. users. International users (Canada, etc.) are responsible for understanding their own local regulations.
• Your responsibility — Contacting the airline, submitting claims, and complying with airline fare rules remain your responsibility.

16. Changes to Terms

We may update these Terms from time to time. Continued use of TripReclaim after changes constitutes acceptance of the new Terms. We will notify you of material changes by email. Changes to our SMS program terms will be communicated with at least 30 days notice where required by applicable law.
